All You Need to Know About Partial Occupancy Certificate

While taking possession of an apartment or a property, an occupancy certificate is issued by the statutory local development authority. This certificate permits a developer to let purchasers occupy the property and is obligatory for any structure with more than five apartments. This is Occupancy Certificate, also OC, as it is famously known. But do you know about the Partial Occupancy Certificate? Well, if not, keep reading!

What is a Partial Occupancy Certificate?

A Partial Occupancy Certificate is issued to large projects built in different phases. Once a specific block is completed, the concerned authorities (BDA in the case of Bangalore), after inspecting the structure, grant it a Partial Occupancy Certificate. Similarly, as the following block finishes, partial OC is issued to that. Once the whole project is complete, Partial OC is substituted with one common OC for the whole project. In a nutshell, a Partial OC permits only a portion of the completed residential project to be open for occupancy.

Validity of Partial Occupancy Certificate

Partial OC is valid until the entire project is completed and the concerned authorities issue the Final OC for the entire project.

What does the law state?

According to Section 5.7 of the Bangalore Building Bye-laws 2003, "No one shall occupy or permit any other person to occupy any new project or part of a new project for any purpose whatsoever until occupancy certificate to such projects or part thereof has been permitted by an officer authorized to issue such certificate if in his opinion in every respect the project is completed according to the sanctioned plans and ready for the use for which it is erected. In some unique cases, the concerned authority may permit partial occupancy for distinct floors of a building." In simple words, on completion of the project, the developer must apply to the Statutory Authority (BBMP/ BDA) for an Occupancy Certificate.

Is the concept new?

Well, it's not really new. But since phased construction is gaining immense prominence, the concept of the Partial Occupancy Certificate is also becoming famous.

Are there any advantages of POC?

From a financial view, immediate possession is the most significant advantage. Unlike OC, you can apply for an electricity connection or a water connection with a Partial occupancy certificate.

On the contrary!

With a Partial Occupancy Certificate, you may not get approval from the bank for your home loan. Besides, you can't even apply for a khata certificate as it is given only once you have an OC. Thus, a purchaser must be extra careful when selecting a project, especially if it is in blocks.

When to Apply for Partial OC?

Like OC, developers must apply for a Partial OC within 30 days of the tower completion date. Requirements to be met for a project to get a Partial Occupancy Certificate:

  • Fire department clearance.
  • Waste management areas and composting amenities.
  • Rainwater harvesting facility.
  • Proper Sewage treatment plant.
  • Clearance from the Airports Authority of India (if the project is within the range of an airport).
  • Electrical inspectorate certificate, also one for lifts.
  • Just the basement and ground floor can be utilized for parking spaces.

What do homebuyers need to know?

For residential projects being constructed Phase wise, homebuyers must assert on getting a Partial Occupancy Certificate until the entire building is completed. After that, purchasers must assert on getting an Occupancy Certificate from their builder.
